Our Skillset

Our proven, 12-phase system for optimizing our clients’ injury claims:

 

1. Raise Barrier to Insurance

We will create a barrier between you and the opposing insurance.

We will notify insurance that we will handle all communication, documentation, and negotiation.

 

2. Gather Evidence

Every legal claim is established with evidence.

We will immediately start gathering police reports, medical records, photos, videos, and witness statements.

We will send letters of preservation to insurance companies and businesses to make sure they do not get rid of anything that might help your case.

 

3. Assess Limits

There are several types of insurance that may apply to your case: Liability coverage from the other side; Underinsured coverage from your insurance; PIP coverage; Umbrella coverage; and others.

Also, every insurance policy has a limit, or a ceiling, of what coverage is available. The minimum in Utah is $25,000.

We will determine what policies are applicable and what the limits are so that we can help ensure your medical bills will be paid.

 

4. Collaborate with Medical Professionals

Our first core value is “Healing Comes First.” We will contact your doctors and collaborate with them on what treatment and procedures you need to appropriately and quickly heal and how they will be paid for.

This will continue throughout the treatment phase of your case until you are released from medical care.

Your case manager will be in regular contact with you, which includes at least one phone call every 30 days, to help ensure you are on the path to healing.

 

5. Assess Medical Records

This is one of the most complicated phases of the case.

We will obtain and organize your medical records and your medical bills.

We will assess them to determine how they can help or hurt your case.

This includes an assessment of past medical history to determine how that may help or hurt your case.

We assess this information to prepare to combat against the arguments that the insurance defense will surely raise.

 

6. Evaluate Damages

We will provide an in-depth evaluation of your damages, including medical expenses, lost wages, and pain and suffering.

We will assess how the accident has impacted your life.

We will assess whether you need future medical care.

We will assess whether any of your injuries are long lasting or permanent.

Based on our experience, we will then assign what we believe is a reasonable value range to your case, and we will use this as a measuring stick while negotiating the settlement for your case.

This ensures your claim is not shortchanged.

 

7. Prepare Demand

Armed with the evidence, medical records, and damage valuation, we prepare a demand letter with supporting documents (the “demand package”), asking that insurance pay a specified demand amount for your claim.

This is what commences the negotiation process.

 

8. Assertively Negotiate

We then correspond back and forth with the insurance company to attempt to reach a fair resolution for your claim.

We take a tough stance with the insurance company, pushing for a fair settlement that covers your full damages.

We understand insurance tactics and negotiate assertively on your behalf.

 

9. Commence Litigation

If the insurance company is not being fair, we will file a lawsuit, which commences the litigation (court) process. This often eventually leads to a settlement.

 

10. Prepare for Trial

If necessary, we represent you in court with compelling arguments and solid evidence, fighting for your justice.

 

11. Facilitate Resolution and Payment

We handle the settlement documentation and collection of payment.

We make sure the medical bills get paid, and make sure you get paid.

This is more complex than it seems, but we handle all the logistics so you don’t have to worry about it.

 

12. Provide Ongoing Client Support

Even after resolution, we’re here for you—offering guidance, answering questions, and standing as a lasting ally.
